Terms of Use for My Empire Theatre TicketsTickets are sold by Empire Theatre as an agent for and on behalf of “The Presenter” (the party who presents the event, including a promoter or producer or venue as the case maybe, details of which are available from Empire Theatre, and whose name may appear on the front of the ticket), and subject to the following terms and conditions.1 Tickets are sold subject to: the conditions printed on the ticket (reverse): Empire Theatres Terms and Conditions published on the Empire Theatre website and available at all points of sale: and in accordance with the Live Performance Australia Code of Practice for the Ticketing of Live Entertainment in Australia. CLICK HERE TO VIEW THE LPA CONSUMER CODE 2 Generally there is no right to a refund or exchange except as required by law, and / or as provided in the LPA Code of Practice for the Ticketing of Live Entertainment in Australia. CLICK HERE TO VIEW THE LPA CONSUMER CODE 3 “The Presenter” reserves the right to add, withdraw or substitute artists, vary prices, advertised programmes, venue, seating arrangements & audience capacity. 4 Entry may be refused if tickets are not purchased from Empire Theatre or any other authorised point of sale, or are damaged, defaced in any way. In the event that a duplicate copy of a ticket appears, Empire Theatre and the venue reserves the right to request proof of identity and proof of purchase. Unauthorised duplicate ticket holders will be refused entry to the venue. 5 Tickets must not be resold or offered for resale at a higher price than the price printed on the ticket. If a ticket is sold or used in contravention of this condition, the ticket may be seized or cancelled without refund or exchange and the bearer of the ticket may be denied admission. 6 If Empire Theatre reasonably forms the view that a ticket has been purchased with a stolen card: or has been sold in violation of clauses 4 and 5: or has been otherwise purchased or acquired fraudulently, Empire Theatre may cancel the ticket without refund. 7 The right of admission is reserved, and late arrival may result in non-admittance until a suitable break in the programme OR nonadmittance to the event. 8 The ticket holder must comply with all security requirements of “The Presenter” as a condition of admission to the event, which may include but not be limited to a search of a person and / or their possessions (including bags and clothing) and / or confiscation of prohibited items, at the time of entry to the venue. 9 Audio & video recording devices may not be permitted into the “Venue”p> 10 Patrons who disrupt a performance or are in use or possession of a prohibited device, or who fail to produce ID as appropriate, may be asked to leave the venue without refund of ticket purchase. 11 Unreserved / General Admission seat tickets cannot be reprinted if misplaced due to the potential for duplication or fraud. It is strongly advised that you choose the secure option for delivery of your tickets, or collect in person from the Empire Theatre or the “Venue” and keep in a secure place. 12 The right is reserved to charge a fee for replacement of tickets. 13 Ticket refunds and exchanges are at the discretion of the event promoter. Some promoters will allow refunds / exchanges in certain circumstances and some will not. The promoter reserves the right to not allow refunds / exchanges. 14 When refunds are permitted, or in the event of the cancellation of a performance, monies will only be refunded via the original payment method (credit card, eftpos or cash). Only the ticket price will be refunded, transaction fees are collected by the ticketing provider and are not refundable. 15 Where tickets are purchased through a third party authorised agent, monies will be refunded by the agent. It is the agent’s responsibility to return these monies to their customers. 16 Some events may have special conditions attached that are not covered by these terms and conditions and will be listed on the event web page. 17 Unless specified everyone from 12 months of age requires a ticket for entry. TERMS AND CONDITIONS OF SALE* (COVID-19 RELATED) Tickets are sold by Empire Theatre as an agent for and on behalf of “The Presenter” (the party who presents the event, including a promoter or producer or venue as the case maybe, details of which are available from Empire Theatre, and whose name may appear on the front of the ticket), and subject to the following terms and conditions. 1. When purchasing tickets, patrons agree to provide their contact details, including mobile phone number, email or residential address: and the contact phone number and residential address of accompanying ticket holders. 2. These contact details, along with seating allocations, will be kept at the venue for 56 days from the day of the performance. 3. Patrons acknowledge the venue may be required by law to provide contact information to public health officers on request. 4. The Venue will not share this contact information with any third party other than the relevant health authority, and will not use the information for promotional purposes. 5. Patrons must not attend if they have Covid 19 related symptoms, have been in close contact with a person who is Covid 19 positive, have travelled overseas or to a Covid 19 hotspot in the past 14 days or are Covid 19 positive. 6. Patrons must not attend if they are required to self-isolate and the event falls within the isolation period. 7. Patrons agree to abide by all social distancing and health protocols. 8. Patrons agree to follow the instruction of venue staff at all times. 9. If patrons do not comply with protocols or authorised requests when on the venue premises they may be asked to leave immediately without refund or further recourse. 10. Refunds or exchange of tickets will be available to any customer who is required to self-isolate (due to being a confirmed case or is a close contact of a confirmed case) and the event falls within the isolation period. 11. Seating will be allocated by the venue based on the size of the group, time of booking and venue configurations, to allow compliance with current social distancing requirement. 12. Disclaimer: Patrons acknowledge that while the venue has taken all reasonable health and safety precautions to keep the audience, staff and performers safe, patrons enter the venue at their own risk without recourse to claim against the venue regarding health outcomes. |
