The Mets or Tickets.com may suspend or terminate your My Mets Tickets account if you are not qualified to use the Services.

2. Mets Ticket Holders and Applicable Games. Not all Ticket account holders of record are authorized by the Mets to use My Mets Tickets to sell any Ticket on the SeatGeek Marketplace, to act on any Ticket through Ticket Forward or to purchase Ticket Auctions. A. Selling a Ticket.

    1. Non-Authorized Ticket Holders. Non-authorized Ticket account holders are not authorized to sell any Tickets on the SeatGeek Marketplace through My Mets Tickets, even if such Ticket[s] were previously bought through the SeatGeek Marketplace.

    2. Seller and Buyer. You agree that when you use My Mets Tickets to access the SeatGeek Marketplace in order to sell any Ticket, each of those transactions is between you and other My Mets Tickets or SeatGeek users, as applicable, and that none of the Mets, Tickets.com or MLBAM are parties to any such transaction. The sole purpose of the Mets, Tickets.com and MLBAM is to provide the technology to facilitate the sale of your Tickets through your use of the Services. None of the Mets, Tickets.com or MLBAM is acting as an agent for either the buyer or seller.

    3. Title to Sold Tickets. After you have posted a Ticket on the SeatGeek Marketplace from your My Mets Tickets account and a buyer has elected to purchase that Ticket, title to the Ticket will automatically be transferred to the buyer. None of the Mets, Tickets.com or MLBAM will ever take title to a Ticket during the course of a Ticket sale. A Ticket sale is complete when a buyer agrees to buy a Ticket that has been sent from the seller's My Mets Tickets account to a buyer on the SeatGeek Marketplace. When a seller posts a Ticket for sale on the SeatGeek Marketplace, the seller is authorizing the Mets and Tickets.com to invalidate the barcode imprinted on that Ticket and to issue a new Ticket to the buyer with a replacement barcode upon completion of the sale. The sales price of the Ticket and any other applicable fees and charges will be charged to the buyer's credit card upon completion of the sale. All Ticket sales are final and not revocable by the seller or the buyer.

    4. Seller's Risk of Loss. No assurances can be made that a buyer will complete a Ticket purchase. A seller bears all risk of loss if, for any reason, a buyer fails to make payment for any Ticket purchase.

    5. Timing of Payment. Upon completion of a sale on the SeatGeek Marketplace, a seller will receive a payment from SeatGeek in accordance with the terms of the SeatGeek Terms of Use Agreement.

    6. No Use of Sold Tickets. After a Ticket is sold on the SeatGeek Marketplace and deactivated that Ticket will no longer be valid for any purpose, including admission to the game designated on that Ticket. A seller will receive one warning if any attempt is made to use such seller's Ticket after such Ticket has been deactivated. Any subsequent attempt to use any deactivated Ticket following such warning may result in the seller's permanent loss of eligibility to use My Mets Tickets and the revocation of the seller's season Ticket account. None of the Mets, Tickets.com, MLBAM or SeatGeek will be liable for any damage, loss or claim relating to anyone's use or attempted use of any deactivated Ticket.

    7. Cancelled Games. After a seller has sold a Ticket to a game, if that game is cancelled, SeatGeek will issue a refund to a buyer in accordance with the terms of the SeatGeek Terms of Use Agreement.

B. Buying a Ticket.

    1. Ticket Seller. None of the Mets, Tickets.com or MLBAM is the seller of any Ticket that you purchase through the SeatGeek Marketplace. The sole purpose of Tickets.com, the Mets and MLBAM is to provide the technology to facilitate the sale of a Ticket to you through the SeatGeek Marketplace.

    2. Service and Other Charges. Any and all fees assessed to a Ticket purchase above the listed Ticket price on the SeatGeek Marketplace are at the discretion of SeatGeek and subject to change without notice. None of the Mets, Tickets.com or MLBAM is acting as an agent for either the buyer or seller.

    3. Obligation to Complete Purchase. You agree that time is of the essence with respect to all Ticket purchases. All title, rights and obligations with respect to any Ticket will pass from the seller to you upon completion of a Ticket purchase. Any failure by you to pay for Ticket[s] purchased through the SeatGeek Marketplace may result in your permanent disqualification from further use of the SeatGeek Marketplace, the SeatGeek Website, or any of the other Services offered through My Mets Tickets, at the Met's discretion.

    4. Cancelled Games. If a game is cancelled after you complete your purchase of a Ticket to that game, SeatGeek will issue a refund to the buyer in accordance with the terms of the SeatGeek Terms of Use Agreement.

    5. Rescheduled Games. If a game is rescheduled after you purchase a Ticket for that game, the Ticket that you purchased will remain valid and use of such Ticket will be subject to those policies applicable to Mets Ticket holders generally, as the Mets may amend such policies from time to time. You are not entitled to a refund or to otherwise retract your purchase of Ticket because the game was rescheduled and it is your responsibility to verify any changes to the information printed on the Ticket, including the date and time of the game.

5. Specific Terms Governing Use of Ticket Forward. If you forward Tickets through Ticket Forward, you agree to be bound to the following terms. If you are a ticket account holder of record and are forwarding Tickets, you are referred to below as the “Sender”. If you are receiving forwarded Tickets, you are referred to below as the “Recipient”.

  • Forwarding Tickets. If you are a Sender, you may forward one or all of your Tickets to a home game to any person, provided that the Recipient has a valid email address. You authorize the Mets and Tickets.com to cancel and deactivate each Ticket that you forward and to reissue a valid Ticket to the Recipient.

  • Receiving Forwarded Tickets. If you are a Recipient, a new Ticket with a replacement barcode will be issued to you for any tickets forwarded to you. Tickets that have been forwarded to you are only valid for the game imprinted on the Tickets, and are only for your own personal use. You may not resell any Ticket that you received through Ticket Forward.

  • Use of Original Ticket After Ticket Forward. The Sender will receive one warning if anyone attempts to use a deactivated Ticket. Any subsequent attempts to use a deactivated Ticket following such warning may result in the permanent disqualification of the Sender from use of the Services and revocation of the Sender's season Ticket account and neither the Mets, Tickets.com nor MLBAM will be liable for any damage, loss or claim relating to the use, or attempted use of any deactivated Tickets.

  • Rescheduled Games. If you are a Recipient, if the game is postponed or rescheduled, use of your Tickets will be subject to those policies applicable to Mets Ticket holders generally, as the Mets may amend such policies from time to time.

  • Cancelled Games. Ticket Forwards for games that are cancelled will be reversed. Tickets that were forwarded will be deactivated and will no longer be valid. Tickets for cancelled games will be subject to those policies applicable to season Ticket holders generally, as such policies may be amended by the Mets from time to time. You understand that Mets games may be cancelled from time to time and that neither the Mets, Tickets.com nor MLBAM are responsible for any loss or damage in connection with such cancelled games.
  • 6. Specific Terms Governing Ticket Auction. Ticket Auction is a dynamic transaction environment which allows ticket buyers to purchase tickets at market value by auction. The ticket price is set based on the auction results. If you bid on or purchase a Ticket through Ticket Auction you agree to be bound by the following terms:

  • By using the Ticket Auction Services, you also agree to adhere to any and all terms and conditions, rules, policies, regulations and directions of Tickets.com as such may be amended from time to time. In addition, you agree to adhere to any and all terms and conditions, rules and policies (a) printed on admission tickets to games played by the New York Mets and all other laws, rules, and policies applicable to events at Citi Field; (b) the terms, conditions and policies set forth in the Ticket Auction Frequently Asked Questions; and (c) the Terms of Use and Privacy Policy applicable to this Web site, each of which is incorporated as part of this Agreement by this reference. Specifically, you agree to use the Ticket Auction Services subject to and in accordance with the following terms and conditions and, where applicable, you represent the same to be true:

  • You understand and agree tickets offered for sale via Ticket Auction are being offered for sale by the New York Mets. You are paying market value for these tickets. You are not obligated to purchase any tickets until you click "I agree" and have provided your credit card billing information.

  • Availability of Tickets. Tickets sold in the Ticket Auction are determined by the Mets. You are bidding on the right to purchase seats in the locations and combinations noted in the auction, as determined by the Mets. No other combinations or locations are available as part of this auction and no other rights are granted.

  • Ticket price and other charges. When you buy a ticket through Ticket Auction, the ticket price is market value of the ticket as determined by the winning auction bid. All charges will be collected at the time the sale transaction is complete.

  • Registration and Payment. To participate in the auction, you must register on the auction Web site and provide a valid credit card (name on card, card number, expiration date, etc.). The credit card will not be billed until the end of the auction. The card provided by the Auction Winner will be billed at the close of the auction.

  • Reserve. If an auction has a reserve price (the "Reserve Price") and no bidder bids higher than the specified reserve amount, the tickets will not be sold and there will be no Auction Winner.

  • Determining the winning bid.. At the close of the auction period, the individual placing the highest bid will be deemed to be the winner ("Auction Winner").

  • Increasing your bid. If another bidder places a bid higher than yours, if you wish to continue participating in the auction, you must return to this site and submit a new bid at a price higher than the amount shown as the current high bid. This auction does not use "proxy bidding" or any other automated method of bidding or allow the auction system to automatically place higher bids for you.

  • All bids are final. Once you place a bid, you cannot cancel, retrieve or revise it.

  • Last-minute bidding. Placing a high bid in the closing seconds of an auction listing is possible. All bids placed before a listing ends are valid - even if they're placed one second before the listing ends.

  • Breaking a tie. When you submit a bid, the date and time your bid was submitted are recorded. At the close of an auction, if two or more bidders bid the same amount, the bidder who placed his or her bid first will be the winner. During the auction period, each time you bid, the date and time of your bid are recorded and your information is updated. The dates and times of your previous bids are no longer applicable.

  • Determination of a winning bid is final and binding. Tickets.com and/or Mets reserve the right to refuse to accept any bids, including a bid which would otherwise be deemed to be a winning bid, at any time and for any reason. The Mets reserve the right to sell or not sell a ticket for admission to any person(s) to the full extent permitted by law.

  • Payment. The Auction Winner is responsible for payment in full of the final bid price, applicable service charges and taxes. Payment in full must be made by credit card and must be received by the Mets no later than five business days after the close of the auction. If payment is not received as required, the Mets may void the auction and/or may elect to sell the tickets to others.

  • Obligation to complete purchase. You agree time is of the essence with respect to all ticket purchases. Tickets will be sent to you only upon receipt by the Mets of the payment required in these terms and conditions. Any failure by you to pay for a ticket and the applicable service charges and taxes may result in forfeit of rights to use any Mets tickets purchased or bid on during the auction and in your permanent disqualification from further use of Ticket Auction all in addition to any other remedies available to the Mets and the other Released Parties.

  • Payment problems. If there is a problem processing your payment, then as a Customer Service may attempt to contact you at the phone number(s) on your account. You may provide a new method of payment. If the Mets are not able to contact you at the phone number on your account within 24 hours of the close of the auction and is not otherwise able to resolve the payment issue, your transaction may be cancelled, the auction may be voided.

  • Authorization to charge credit card. By placing a bid, you agree if you are the successful bidder, we may charge your credit card for auction total amount. We will not contact you prior to charging your credit card. Your card will be charged automatically, immediately following the close of the auction.

  • Cancelled and rescheduled games. After you have purchased tickets, the Mets standard policies and procedures applicable to season ticket holders shall apply.
